TERMS OF SALES

These general conditions of sale are concluded between:

and any adult natural or legal person visiting or making a purchase through the online sales site www.labellemidinette-creations.com Hereinafter referred to as "the Buyer"
These conditions are intended to define the terms of sale between the seller and the buyer, from the order to payment and then delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.
The order implies irrevocable acceptance of the general conditions of sale. In the event that the general conditions of sale are subject to change, the applicable conditions will be those in force on the date of the Buyer's order.
The Buyer also declares that he has the capacity to fulfill the general conditions of sale at the time of placing his order.
2. The Product
The virtual store is open and free to all buyers. Its purpose is the sale of jewelery and fancy accessories. Seller puts on line on its website products made in unique pieces or small series, valid within the limits of available stocks. Ordering a product that is not in stock is a priori impossible. If this case were to occur, the seller would inform him as soon as possible and give him the possibility of choosing another product or of canceling his purchase.
Each product sold on the online store is identified by one or more photographs which are intended to be as faithful as possible but cannot ensure perfect similarity with the product sold, in particular with regard to colors due to the settings of the screen of the buyer and the lighting during the shots. These photos are accompanied by the most precise and detailed descriptive text possible. In the event that errors, omissions or inaccuracies occur in this presentation, the seller cannot be held liable. All photographs and texts illustrating the products are only indicative and have no contractual value.
3 - The order
The buyer has the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all of these conditions. All the data provided and the recorded confirmation constitute proof of the transaction.
La belle midinette créations reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
4- Price
The selling prices which are indicated on the site are in euros (€).
VAT is not applicable, art. 293B of the CGI. La belle midinette creations reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the site on the day of the order will be the only one applicable to the buyer. No claim can be made in the event of a price change after the order has been validated.
Unless otherwise stated, prices do not include postage, which is shown separately. Shipping and handling costs of the order are indicated before the validation of the order.
In the event of an order to a country other than metropolitan France, the customer is the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the seller and will be the responsibility of the buyer and are his full responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities. All orders, whatever their origin, are payable in euros.
5. Payment
Payment is due immediately upon order. Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. Payment is made online, by bank card - Carte Bleue, Visa, Eurocard/Mastercard - or through Paypal. In accordance with article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. Payment security is based on merchant authentication, confidentiality and integrity of exchanges.
Confidential data are directly transmitted encrypted on the bank's server without passing through the physical media of the seller's server.
6. Delivery
The customer undertakes to provide all the information useful for the delivery of his purchases. These data will only be used for the order.
To know the fees, and delivery methods, the seller invites you to consult the "Delivery" section.
Delivery times are indicative corresponding to average processing and delivery times. La belle midinette creations cannot be held responsible for the consequences due to any delay in delivery or loss of the package.
The delivery address is provided by the Customer. Any possible input error cannot be the responsibility of the seller. La belle midinette créations authorizes itself to charge additional delivery costs, if products must be reshipped following an address entry error by the customer. The Buyer assumes full responsibility for his choice of delivery method.
7- Satisfied or guaranteed
Under the conditions provided for in Article L121-16 of the Consumer Code and in the context of distance selling, you have a withdrawal period of 14 clear days from the delivery of your order to change your notice and we will refund the full amount of the returned items. Items must be returned new and in their original packaging accompanied by all the accessories delivered including supports or labels.
No returns will be accepted without a prior request to customer service.
Return costs remain your responsibility. If an item is returned by simple shipment and it does not reach us, unfortunately we will not be able to refund you. This is why the seller strongly advises its Customers to return the products by Colissimo or Letter followed.
After its acceptance by our services and according to your wishes, we will proceed to a refund.
Attention : Nevertheless the right of withdrawal does not apply to any partially or completely personalized item.
"In accordance with the legal provisions in force, in particular article L.121-21-8 4° of the Consumer Code, the customer within the meaning of the legal provisions in force on the date of the order, has no withdrawal for contracts:
- supply of products made according to the consumer's specifications or clearly personalized or in limited edition;
- supply of Products which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection; (earrings)
8- Return and exchange
In the case of a damaged or broken jewel or inaccurate, the buyer has 48 hours to dispute the product.
We remind you that upon receipt of your package, it is your duty to check the possible breakage of a jewel.
After this period, the jewelry delivered will be deemed to be compliant and accepted by the customer, and we reserve the right to refuse the exchange, credit note, or refund.
The seller undertakes to refund or exchange damaged or broken jewelry or jewelry that does not correspond to an order within a period less than or equal to 14 working days after receipt of the return by the customer.

8. Liability

10 - Applicable law and competent jurisdiction
Any order automatically entails the customer's acceptance of the general conditions of sale. These general conditions of sale are governed by French law. In the event of a dispute, the French courts will have sole jurisdiction.
